The Online Store always takes care of the consumer’s rights. A consumer cannot waive the rights granted under the Act on Consumer Rights. Provisions of agreements that are less favorable to the consumer than the provisions of the Act on Consumer Rights are invalid, and in their place the provisions of the Act on Consumer Rights apply. Therefore, the provisions of these Terms and Conditions are not intended to exclude or limit any consumer rights to which they are entitled under binding provisions of law, and to ensure the consumer’s benefits. In the event of any inconsistency between the provisions of these Terms and Conditions and the above provisions, the provisions contained in the Act on Consumer Rights take precedence..
1.1 The Online Store, which is available at the following internet address ….., is operated by “RADEX POLAND” Sp. zo.o. entered in the Central Register of Entrepreneurs of the National Court Register under KRS number: 0001081621, having the address of the place where business activities are carried out and the address for service: ul.Przemysłowa 3, 14-200 Iława, NIP: 7441775260 REGON: 280423924, e-mail address: ecommerce@radex.com, telephone number: +48 089 648 75 01.
1.2 These Terms and Conditions are addressed to consumers and business entities using the Online Store, unless a given provision of the Terms and Conditions states otherwise and is addressed exclusively to consumers or exclusively to business entities.
1.3 The administrator of personal data processed in connection with the implementation of the provisions of these Terms and Conditions is the Service Provider. Personal data are processed for the purposes, to the extent and on the basis of the principles set out in the Terms and Conditions of the Online Store. Providing personal data is voluntary. Each person whose personal data are processed by the Service Provider has the right to access their content and the right to update and correct them.
1.4 Definitions:
WORKING DAY – one day from Monday to Friday, excluding statutory public holidays.
REGISTRATION FORM – a form available in the Online Store that enables the creation of an Account.
ORDER FORM – an Electronic Service, an interactive form available in the Online Store that enables the placing of an Order, in particular by adding Products to the electronic shopping cart and specifying the terms of the Sales Agreement, including the delivery and payment method.
CUSTOMER – (1) a natural person with full capacity to perform legal acts, and in cases provided for by commonly applicable provisions of law also a natural person with limited capacity to perform legal acts; (2) a legal person; or (3) an organizational unit without legal personality to which the act grants legal capacity; - which has concluded or intends to conclude a Sales Agreement with the Seller.
CIVIL CODE – the Civil Code Act of 23 April 1964 (Journal of Laws of 1964 No 16, item 93 as amended).
ACCOUNT – an Electronic Service identified by a name (login) and password provided by the Service Recipient; a set of resources in the teleinformation system of the Service Provider in which data provided by the Service Recipient and information about Orders placed by them in the Online Store are collected.
CONSUMER – a natural person who enters into an agreement with the SELLER (a sales agreement, an agreement for the provision of an electronic services) not directly related to their business or professional activity.
NEWSLETTER – an Electronic Service, an electronic distribution service provided by the Service Provider via e-mail, which allows all Service Recipients to automatically receive from the Service Provider regular content of subsequent editions of the newsletter containing information about Products, news and promotions in the Online Store.
PRODUCT – a movable item available in the Online Store which is the subject of a Sales Agreement between the Customer and the Seller – together with the installation service, if the Customer chooses the installation option.
TERMS AND CONDITIONS – these Terms and Conditions of the Online Store
ONLINE STORE - the Online Store of the Service Provider available at the following address.
SELLER; SERVICE PROVIDER – “RADEX POLAND” Sp. zo.o. entered in the Central Register of Entrepreneurs of the National Court Register under KRS number: 0001081621, having the address of the place where business activities are carried out and the address for service: ul.Przemysłowa 3, 14-200 Iława, NIP: 7441775260, REGON: 280423924, e-mail address: ecommerce@radex.com, telephone number: +48 089 648 75 01.
SALES AGREEMENT – a sales agreement for a Product concluded between the Customer and the Seller through the Online Store.
ELECTRONIC SERVICE – a service provided electronically by the Service Provider for the Service Recipient via the Online Store.
SERVICE RECIPIENT – (1) a natural person with full capacity to perform legal acts, and in cases provided for by commonly applicable provisions of law also a natural person with limited capacity to perform legal acts; (2) a legal person; or (3) an organizational unit without legal personality to which the act grants legal capacity; - using or intending to use the Electronic Service.
ACT ON CONSUMER RIGHTS, ACT – the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014 item 827 as amended).
ORDER - a statement of will of the Customer submitted using the Order Form and directly aimed at concluding a Sales Agreement for the Product with the Seller.
2.1 The following Electronic Services are available in the Online Store: Folmularz zamówinia, Account and Newsletter.
2.1.1 Account – using the Account is possible after the Service Recipient completes all three consecutive steps – (1) filling in the Registration Form, (2) clicking “Set up account”, and (3) confirming account creation by clicking the confirmation link automatically sent to the e-mail address. In the Registration Form the following Service Recipient data are required: first name and last name/company name, address, e-mail address, contact phone number and password. For Service Recipients who are not consumers, it is also necessary to provide the company name and NIP number.
2.1.2 Electronic Service - the Account is provided free of charge for an indefinite period. The Service Recipient has the right, at any time and without giving a reason, to delete the Account (unsubscribe from the Account) by sending a relevant letter to the Service Provider, in particular via e-mail to the following address: ecommerce@radex.com or in writing to: ul.Przemysłowa 3, 14-200 Iława.
2.1.3 Order Form – using the Order Form starts when the Customer adds the first Product to the electronic shopping cart in the Online Store
Placing an Order takes place after the Customer completes two consecutive steps in total – (1) after filling in the Order Form and (2) clicking on the Online Store page and after filling in the Order Form field “I confirm the purchase” – until this moment it is possible to modify the entered data independently (for this purpose, follow the messages displayed and the information available on the Online Store website). In the Order Form the Customer must provide data concerning the Customer: first name and last name/company name, residential address, e-mail address, contact phone number and data concerning the Sales Agreement: Product(s), quantity of Product(s), place and method of delivery of Product(s) and method of payment. For Customers who are not consumers, it is also necessary to provide the company name and NIP number.
2.1.4 Electronic Service-Order Form is provided free of charge, is one-time in nature, and ends at the moment an Order is placed using it or at the moment the Service Recipient stops placing an Order using it.
2.1.5 Newsletter – to use it, you must enter in the “Newsletter” tab visible on the Online Store website the e-mail address to which subsequent editions of the Newsletter are to be sent and click the “Subscribe” icon. You can also subscribe to the Newsletter by ticking the appropriate checkbox when creating an Account – upon creating the Account, the Service Recipient is subscribed to the Newsletter.
2.1.6 The electronic service Newsletter is provided free of charge for an indefinite period. The Service Recipient has the possibility at any time and without giving a reason to unsubscribe from the Newsletter (resign from the Newsletter) by sending a relevant letter to the Service Provider, in particular via e-mail to the following address: ecommerce@radex.com or in writing to: ul.Przemysłowa 3, 14-200 Iława.
2.2 Technical requirements necessary to cooperate with the teleinformation system used by the Service Provider: (1) laptop, computer or other multimedia device with Internet access; (2) access to e-mail; (3) an internet browser: Mozilla Firefox version 11.0 or higher or Internet Explorer version 7.0 or higher, Opera version 7.0 or higher, Google Chrome version 12.0.0 or higher; (4) recommended minimum screen resolution: 1024x768; (5) enabling in the internet browser the option to save Cookies files and handling of Javascript.
2.3 The Service Recipient is obliged to use the Online Store in a manner consistent with the law and good practice, taking into account respect for personal rights and copyright and intellectual property rights of the Service Provider and third parties. The Service Recipient is obliged to enter data consistent with the actual state of affairs. The Service Recipient is prohibited from entering content of an unlawful nature.
2.4 Complaint handling procedure:
2.4.1 Complaints related to the provision of Electronic Services by the Service Provider and other complaints connected with the operation of the Online Store (excluding the Product complaint system, which is presented in point 6 of the Terms and Conditions) the Service Recipient may submit as follows:

2.4.3 In electronic form via e-mail to: ecommerce@radex.com
2.4.4 The Service Recipient is recommended to include in the description of the complaint: (1) information and circumstances regarding the damage related to the subject of the complaint, in particular the type and date of occurrence of the irregularity; (2) the Service Recipient’s request; (3) contact details of the person submitting the complaint; (4) and attaching the protocol and photos of the damage – this will facilitate and speed up the complaint handling by the Service Provider. The requirements set out in the previous sentence are for assistance only and do not affect the effectiveness of complaints submitted while omitting the recommended complaint description.
2.4.5 The Service Provider’s response to the complaint takes place immediately, no later than within 14 working days from the date the complaint is submitted.
3.1 A Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order using the Order Form in the Online Store in accordance with point 2.1.2 of the Terms and Conditions.
3.2 The price of the Product visible on the Online Store website is given in Polish zlotys and includes taxes. The Customer will be informed on the Online Store pages, during placing the Order, about the total price including taxes of the Product that is the subject of the Order, and about the delivery costs (including transport charges, handling and postal services) and other costs, and where it is not possible to determine the exact amount of these charges – about the obligation to pay them; this also occurs at the moment the Customer expresses their will to be bound by the Sales Agreement.
3.3 Procedure for concluding a Sales Agreement in the Online Store using the Order Form.
3.3.1 The conclusion of a Sales Agreement between the Customer and the Seller begins after the Customer has first placed an Order using the Order Form in the Online Store in accordance with point 2.1.2 of the Terms and Conditions.
3.3.2 After placing the Order, the Seller confirms receipt as soon as possible and at the same time accepts the Order and forwards it for processing. Confirmation of receipt and acceptance of the Order for processing results from the Seller sending the Customer an e-mail message to the e-mail address of the Customer provided when placing the Order, which among other things contains the Seller’s statements about receiving the Order and accepting it for processing, and also confirmation of concluding the Sales Agreement. Upon receipt by the Customer of the e-mail confirmation message, a Sales Agreement between the Customer and the Seller is concluded.
3.4 Securing, recording and making the content of the Sales Agreement available to the Customer occurs by (1) making these Terms and Conditions available on the Online Store website and (2) sending the Customer the e-mail message referred to in point 3.3.2 of the Terms and Conditions. The content of the Sales Agreement is additionally published, recorded and secured in the IT system of the Seller’s Online Store.
3.5 A Customer who is a natural person conducting business activity, when sending an order, may be required to submit a statement that the order placed by them is for professional purposes. The Seller reserves the right to suspend order processing until the Customer submits such a statement.
4.1 The Seller will enable the Customer to use the following payment methods under the Sales Agreement:
4.1.1 Payment by bank transfer to the Seller’s bank account. A consumer is obliged to make payments using a payment account if the one-time value of the transaction, regardless of the number of payments resulting from it, exceeds 20,000 PLN or is equal to that amount. A Customer who is not a consumer is obliged to make payments using a payment account if the one-time value of the transaction, regardless of the number of payments resulting from it, exceeds 15,000 PLN gross or is equal to that amount.
4.1.2 Electronic payments via the service Autopay.pl – possible payment methods are provided on the Online Store website in the information section concerning payment methods and on the website http://www.autopay.pl.
